EU = mc12

It doesn't mater how fast you chase the European Commission, you never catch up with the money. This fact can be expressed as EU = mc12, where EU is the immovable object, mc = mass corruption and 12 is the number of years that it has been impossible to perform a budgetary audit.

It is expected that the European Commission will launch a pre-emptive propaganda strike today. The Court of auditors are expected to announce next month that they cannot sign off the EU budget for the 12th year running. The commission will try and blame the member states, for the commission's own failure to manage the budget within the terms of the European Union Treaty



The European Union and the EU Commission draws upon its LEGAL BASIS on budgetary maters from Article 268 to 280 of the EC Treaty. As the European Union has not performed or been in legal compliance for 12 years we should now withdraw from the European Union using the provision of Article 61 of the Vienna Convention on the Law of Treaties

A party may invoke the impossibility of performing a treaty as a ground for terminating or withdrawing from it if the impossibility results from the permanent disappearance or destruction of an object indispensable for the execution of the treaty. If the impossibility is temporary, it may be invoked only as a ground for suspending the operation of the treaty.

It is a criminal offence to name anyone who complains to police that they have been the victim of a sexual offence, even if the alleged attacker is found not guilty in court. But yesterday Lord Campbell-Savours named a “serial and repeated liar” whose false allegations resulted in an innocent man being jailed for a sex attack.

Lord Campbell-Savours was able to do this because he is protected from legal action for comments made in the House of Lords by Parliamentary Privilege.

That Privilege is granted to him in law by the provisions of the Bill of Rights 1689, which states: That the freedom of speech, and debates or proceedings in parliament, ought not to be impeached or questioned in any court or place out of parliament.

This is the same Bill of Rights 1689, which also states: That all grants and promises of fines and forfeitures of particular persons before conviction, are illegal and void.

Lord Campbell-Savours: My Lords, is not the inevitable consequence of the workings of the law as currently framed that we will carry on imprisoning innocent people such as Warren Blackwell, who was falsely accused by a serial and repeated liar, Shannon Taylor, who has a history of making false accusations and having multiple identities? As a result of her accusations he spent three and a half years in prison following a shabby and inadequate police investigation and was exonerated only when the Criminal Cases Review Commission inquiry cleared him and traced her history. Should not mature accusers who perjure themselves in rape trials be named and prosecuted for perjury?

If the Bill of Right works for Parliamentarians, then it most certainly should work for us plebs too

A Polish student has won a competition to design a logo for the EU's 50th birthday celebrations next year.

The competition was entered by 1,700 students, who tried to "encapsulate the idea of European co-operation... and the future of Europe in particular". (BBC)

the Police and Justice Bill

When the current Police and Justice Bill was laid before Parliament, the then Home Secretary Charles Clarke, made the following statutory declaration

"In my view the provisions of the Police and Justice Bill are compatible with the Convention rights".

The 'convention rights' he refers to, are those 'articles' of the EUROPEAN CONVENTION ON HUMAN RIGHTS, which were enshrined into United Kingdom law by this Labour Government through the provisions of the Human Rights Act 1998

The Government declard at the time that the general purpose of the Human Rights Act was to protect human rights and fundamental freedoms and to maintain and promote the ideals and values of a democratic society. It sets out the basic rights of every person together with the limitations placed on these rights in order to protect the rights of others and of the wider community. ... The Act makes available in UK courts a remedy for breach of a Convention right, without the need to go to the European Court of Human Rights in Strasbourg.

There's a proposal in clause 15 of the current Police and Justice Bill allowing the Home Secretary to give 'authority figures' other than police the power to hand out fixed penalty fines of £80 or £100. He or she will be able to do this whenever they deem it "necessary" and without primary legislation in parliament.

So lets look at Section 11(a) of the Human Rights Act 1998 it states: A person's reliance on a Convention right does not restrict- any other right or freedom conferred on him by or under any law having effect in any part of the United Kingdom

The BILL OF RIGHTS 1689 still has effect in English law and it quite clearly states:

That the pretended power of suspending the laws or the execution of laws by regal authority without consent of Parliament is illegal;

That the pretended power of dispensing with laws or the execution of laws by regal authority, as it hath been assumed and exercised of late, is illegal;

That the commission for erecting the late Court of Commissioners for Ecclesiastical Causes, and all other commissions and courts of like nature, are illegal and pernicious;

That levying money for or to the use of the Crown by pretence of prerogative, without grant of Parliament, for longer time, or in other manner than the same is or shall be granted, is illegal;

That excessive bail ought not to be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted;

That jurors ought to be duly impanelled and returned, and jurors which pass upon men in trials for high treason ought to be freeholders;

That all grants and promises of fines and forfeitures of particular persons before conviction are illegal and void;

So there you have it, He lied, it is not compatible and there is No Need for Strasbourg.

Attacks Credits
