Saltire Satire



Wonko’s World reports that a couple of days ago that the Scottish Parliament forced fellow Witanagemot blogger, Gareth, to remove a spoof Scottish Parliament homepage.

He was asked to remove the offending page as it had found its way into the media and falls foul of their copyright statement, which basically says you can't use their logo for satire.

Battle won, but not the War

Robin de Crittenden beats Worcester Council but only on a technicality. Robin de Crittenden's aim was to use the 1689 Bill of Rights to overturn a parking ticket fine of £60 issued by Worcester City Council but the National Parking Adjudication Service's adductor, after taking advice from a High Court judge, allowed the appeal but on the technicality...that Worcester Council had conveniently failed to supply any evidence of a Traffic Regulation Order.

One has to give credit to NPAS and the Government for squirming and wriggling on this, as to uphold the appeal based on the Bill of Rights 1689 would cost local councils in excess of £1,000,000,000 and if not, I can go back to buying my Bananas in pounds and ounces.

I personally think that the Peoples No Campaign need to stop mucking about now and hoist this Government by its own petard. Offence is sometimes your best Defence

Section 7 of the Human Rights Act 1998, states that

A person who claims that a public authority has acted (or proposes to act) in a way which is made unlawful by section 6(1) may-

(a) bring proceedings against the authority under this Act in the appropriate court or tribunal, or
(b) rely on the Convention right or rights concerned in any legal proceedings,
but only if he is (or would be) a victim of the unlawful act.

Section 11 A person's reliance on a Convention right does not restrict-

(a) any other right or freedom conferred on him by or under any law having effect in any part of the United Kingdom

Come on Neil, go for it, they can not use the provisions of section 4 in this instance. The Bill of Rights 1689 and Magna Carta is the foundation of international law.

By all accounts, Brussels bureaucrats are trying to get Britain’s merchant fleet to fly the European flag instead of the “historic Red Ensign”, saying it will improve its image.

David (Cam is on) Cameron said that too much time would have elapsed by the time the Tories returned to power, even if they won the next election, to reverse the decision to amalgamate Scotland's individual regiments.

So what other decisions does he think he will be unable to reverse. Does he not understand that "No Parliament can bind its successor" If he doesn't understand this basic concept of the constitution, what hope for the conservative party, if he became leader?

note: 15 years ago today, Margaret Thatcher resigned. (this was the last time a Tory leader had a willie as well as balls)

100 years ago today, Albert Einstein published his special theory of relativity. It stands as one of the greatest intellectual achievements in the history of human thought.

Special Relativity also spawned the most famous equation in all of physics: E=mc2, expressing the equivalence between matter and energy. This has also been tested experimentally, and rather too often, because it spawned.

Interestingly Craig Murray has successufuly urged the Foreign Affairs Committee to request documents from the Foreign Office to support his evidence for the 'Human Rights Annual Report 2005'

Remember Craig Murray, he served as the United Kingdom's ambassador to Uzbekistan from 2002 until he was discharged in 2004. The reasons for his dismissal are far from clear. Some hold the view that it was his overt criticism of the British government's actions in dealing with the human rights situation in the Central Asian country.

Peter Hain the Northern Ireland Secretary, told the New York-based Irish Echo it would become "increasingly difficult to look at the economy of north and south except as a sort of island of Ireland economy".

Hain said: "We are deepening north-south co-operation in a number of areas. The Northern Ireland economy, though it is doing better than ever in its history, is not sustainable in the long-term.

Subject : Draft Conclusions of the Representatives of the Governments of the Member States on common minimum security standards for Member States' national identity cards

1. The Hague Programme of 5 November 2004 requested the Council and the Commission to prepare for the development of minimum standards for national identity cards. In addition, the special Justice and Home Affairs Council of 13 July 2005, called in response to the London bombings, reinforced the need for this work in the following terms: “The Council…calls on Member States to agree common standards for security features and secure issuing procedures for ID cards (December 2005), with detailed standards agreed as soon as possible thereafter.”

2. The Article 6 Committee has considered the physical security features of identity cards. They have now produced interim conclusions; their final conclusions will be issued in due course, in accordance with the remit of the 13 July Justice and Home Affairs Council.

3. In parallel to this work, an ad-hoc group of experts from Member States has considered the security of issuing procedures and has produced conclusions.

4. SCIFA is invited to agree the attached Conclusions with a view to submitting them for adoption by Representatives of the Governments of the Member States meeting in the margins of the Justice and Home Affairs Council on 1-2 December 2005.

Dum Dum and Dumber

In July, Sir Ian Blair, the chief of London's Metropolitan Police, apologised to the family of the Brazilian man shot by the police, but left open the possibility that more people could be shot as part of the war on terrorism

The Brazilian man shot dead by police in the mistaken belief that he was a suicide bomber was killed with a type of bullet banned in warfare under international convention. The Daily Telegraph.

There is no legal prohibition on police use of such ammunition. The Home Office confirmed last night that "chief officers may use whatever ammunition they consider appropriate to meet their operational needs".

EU impossibility of performance

The European Court of Auditors publishes today its Annual Report on the implementation of the 2004 EU general budget

The Court's President, Mr Weber said today "The Court found that the vast majority of the payments' budget was again materially affected by errors of legality and regularity in the underlying transactions. This is a result of inherently risky transactions, and supervisory and control systems that are ineffective in terms of limiting the risk of irregularity to an adequate level"

In other words, for the 11th year running the books of this corrupt organisation don't balance and we cannot legally sign off the accounts.

Well, there is a solution: We should withdraw from the European Union. This is "Impossible" some might say, we have to meet our solum treaty obligations. But it should be remembered that a treaty obligation works both ways and the EU have clearly not met its side of the bargain.

The EU draws its LEGAL BASIS on budgetary maters from Article 268 to 280 of the EC Treaty. As it has not performed or complied for 11 years we can withdraw using the provision of Article 61 of the Vienna Convention on the Law of Treaties

Article 61 Supervening impossibility of performance

A party may invoke the impossibility of performing a treaty as a ground for terminating or withdrawing from it if the impossibility results from the permanent disappearance or destruction of an object indispensable for the execution of the treaty. If the impossibility is temporary, it may be invoked only as a ground for suspending the operation of the treaty.

11 years of non compliance feels fairly permanent to me.

Toxteth riots remembered

Today when we learn that the The European Union has offered France €50 million to help rebuild its inner cities, following more than a fortnight of violence and unrest in Paris. Liverpool is hosting URBACT a major European Commission conference about urban regeneration, which will be attended by a delegation from France

Twenty years ago violence erupted on the streets of Toxteth, Liverpool.

It was widely argued that like the current problems in Paris, that the riots in Liverpool happened because of chronic unemployment, racism, bad housing and poor education in an area with a large population of black and mixed-race residents.

So what will Paris learn from the Liverpool's experience

UK pair held without trial in Iran

A British man has described how he, his wife and an Australian man were kept "hostage" for 13 days by Iranian authorities during a sailing trip. BBC News

They were held without TRIAL for 13 days under IRANIAN anti Terrorism Laws.

The trio were seized at gun point by Iranian Navy patrol boats on 28 October, when they sailed their boat to the disputed island of Abu Musa, which is claimed by both Iran and the United Arab Emirates.

They were then taken to the Iranian port of Bandar Abbas, where they were questioned repeatedly by officials.

If it was Britain, they would be able to be held and questioned without trial for 28 Days.

They were released without charge after 13 days, what's the problem

E-mail your MP and ask them to Lobby the Iranian government. IRAN should be brought into line. Like Britain, IRAN needs to extend the period that suspects can be held for questioning without charge to 28 days.

It really is shameful that the Iranian police have not got these powers and are unable to lobby their own government to get their detention laws changed.

Prudent

Yesterday, the Government knew there was a critical vote in Parliament. So why did Gordon Brown fly to Israel only to get on the next plane home to Vote in the House of Commons this afternoon.

How much public money has been wasted on the "mile high" Joy Ride

Given that he did not conclude any Government business on this trip, but is returning on Labour Party business, should he pay for this flight himself.

If not, then it should be recognised that this is a clear breach of Part 1 Section 4 of the Ministerial Code

Ministers' Constituency and Party Interests.
4.1 It is wrong in principle for Ministers to use for Party or constituency work facilities provided at Government expense to enable them to carry out their official duties.

Charles Clarke insincere apology

Dear Anoneumouse

I would like to apologise for the questionnaire (Sham Survey) which was attached to the message that I sent out to party supporters on Friday. It was not intended to gauge public opinion but to start a political debate around the proposals currently being debated in Parliament. Many people have raised with me perfectly valid concerns about how the questions were drafted. I can only say that I share those concerns and give my assurance that questions of this type will not used in the future.

My interpretation

I screwed up, I tried to pull a fast one, but the public saw through my Sham Survey. In an attempt to save face I am making a Campbell inspired apology in the hopes that if Cherie can get a way with an insincere apology then so can I. I am not a Super Man, Juggling my balls as well as Tony's, I was bound to make a mistake. I promise that next time I try to pull a stunt like this, I will use more subtle and subversive tactics and wont be caught out so easily.

"I am just following orders"



On October the 19th I posted a Comment on Margot Wallstoms blog

The EU's de Clercq Report 1993 devised initiatives to ensure that:

"...European identity must be 'ingrained in people's minds' as a 'good product' using marketing techniques and that certain social categories, particularly 'women and youth', should become 'priority target groups'. More controversially, it suggested that newscasters and reporters must themselves be targeted, they must themselves be persuaded about European Union...so that they subsequently become enthusiastic supporters of the cause."

This was quickly rebutted by Margot Wallstroms Moderator with

Anoneumouse: The de Clerq Report contains interesting theories about communication. The reality is that it is simply not possible to 'target' newscasters and reporters to persuade them that the EU is a 'good thing'. All you have to do is read the European press on a daily basis to see that coverage is sometimes fair, sometimes unfair, sometimes pro and sometimes anti European. There are hundreds of accredited journalists in Brussels who attend the Commission's press briefings every day but that does not stop them criticising the Commission whenever they want to.

So what does the new EU Deputy Propaganda Minister to the UK tell us in The Times today

I don't even love Europe.

Rather than lie low like his predecessors, he intends to embrace the initiatives as set out in the EU's de Clercq Report

So what is Mr Reijo Kemppinen going to do.

He has taken on extra staff to change the debate by arranging conferences and seminars, sending teams of press officers out to speak to regional newspapers, and setting up EU information centres around the country.


As Hans Fritsche discovered "just following orders" is no defence.

Auld Alliance

It would appear that the Auld Alliance is alive and well and still thriving, especially amongst the state dependent Scots . As Paris and other French towns burn, firefighters and police were subjected to a series of attacks by gangs of youths during a bonfire night of violence across Scotland. The Scotsman

As intellectuals (PROFESSOR RICKY BURDETT on BBC start the week) are now arguing that the current French violence is all down to "Social issues and physical structure" i.e. how French suburbs are designed, one has to wonder whether the close association that Scotland has had with France through the Auld Alliance, isn't the reason for the youth violence in Scotland today.

Although the Auld Alliance was principally a military and diplomatic agreement, the alliance also granted "dual citizenship" in both countries. Thus, its influence also extended into the lives of the Scottish population in a number of ways: including architecture, law, and its social structure.

The former Tory prime minister hit out at "Blairites" who had "dishonestly" attacked the Conservatives for "sleaze" when he was in power. "I'm not smugly grinning to myself saying 'Good, they're in trouble'," he said in in interview with ITV1's Jonathan Dimbleby programme.

Sleaze watchdog in code review call
The head of the Government sleaze watchdog has called for an urgent review of the Ministerial Code in the wake of David Blunkett's downfall. Sir Alistair Graham, chairman of the Committee on Standards in Public Life, also called on Prime Minister Tony Blair to ensure action was taken against those who broke rules. He told the Independent on Sunday he disagreed with Mr Blair that Mr Blunkett, who resigned as Work and Pensions Secretary on Wednesday in a shares row, had not been guilty of impropriety

TONY BLAIR is set to face an unprecedented parliamentary inquiry into his conduct in the run-up to the Iraq war. A coalition of Tory and Labour MPs is to table a motion to set up a Commons committee to examine “the conduct of ministers” both before and after the war. They believe they need the support of about 30 Labour rebels to succeed.

Sir Menzies Campbell, the Lib Dem foreign affairs spokesman, said his party had not supported earlier attempts to impeach the prime minister but was in no doubt that parliament should hold its own inquiry.

The Seven Principles of Public Life

Selflessness Holders of public office should act solely in terms of the public interest. They should not do so in order to gain financial or other material benefits for themselves, their family, or their friends.

Integrity Holders of public office should not place themselves under any financial or other obligation to outside individuals or organisations that might seek to influence them in the performance of their official duties.

Objectivity In carrying out public business, including making public appointments, awarding contracts, or recommending individuals for rewards and benefits, holders of public office should make choices on merit.

Accountability Holders of public office are accountable for their decisions and actions to the public and must submit themselves to whatever scrutiny is appropriate to their office.

Openness Holders of public office should be as open as possible about all the decisions and actions that they take. They should give reasons for their decisions and restrict information only when the wider public interest clearly demands.

Honesty Holders of public office have a duty to declare any private interests relating to their public duties and to take steps to resolve any conflicts arising in a way that protects the public interest.

Leadership Holders of public office should promote and support these principles by leadership and example.
